Anyone who is in good physical health and weighs approximately between 30 kg and 100 kg may participate in a flight. Paragliding Oberbayern powered by Thermik-Flug undertakes to transport the person named in the registration or voucher as a passenger using a paraglider approved for two persons. The following contractual conditions apply; any amendments require written confirmation by Paragliding Oberbayern powered by Thermik-Flug. These conditions are accepted by the passenger upon registration/booking and/or payment of the invoice amount and/or verbal agreement to a transport contract and/or redemption of a voucher.
A passenger flight is booked by registration or by ordering a voucher. Registration or voucher orders can be made verbally, in writing, by email, or via messaging services. The date for the passenger flight is agreed upon with Paragliding Oberbayern powered by Thermik-Flug verbally, in writing, by email, or via messaging services and is confirmed accordingly.
It is expressly pointed out that even confirmed appointments do not constitute a guarantee of transport if weather conditions on the day of the flight do not permit it. In the event of rescheduling or cancellation, there is no entitlement to compensation, refund, or reimbursement of any expenses incurred. However, the right to reschedule the flight remains.
By registering or placing an order, the passenger/customer undertakes to pay the flight price in full. The flight price is payable without deduction. In the case of booking a passenger flight, payment is due immediately after the flight in cash. In the case of voucher orders, the flight price must be paid immediately upon invoicing. The voucher only becomes valid once payment has been received and is activated accordingly.
In the case of booking a passenger flight, there is a right of withdrawal within 14 days of booking confirmation; in the case of purchasing a voucher, there is a right of withdrawal within 14 days of receipt of the voucher. Any withdrawal after this period is excluded. The cost of returning the voucher shall be borne by Paragliding Oberbayern powered by Thermik-Flug.
The flight area is determined by the tandem pilot depending on weather conditions. The pilot is also responsible for all details regarding the execution of the flight. The pilot is entitled to cancel the flight if the passenger is deemed unsuitable or if external conditions (weather, wind, terrain) are considered unsuitable.
Travel costs to the flight location are borne by the passenger. Costs for cable cars or similar (e.g. landing fees) are not included in the flight price. All-in-one packages include one cable car ascent. Additional transport costs, for example due to weather conditions (e.g. descent), are not included.
Vouchers for tandem flights are valid for 3 years (statutory limitation period). If the service is not redeemed within this period, the voucher expires. If the service cannot be provided on at least three agreed dates, the validity of the voucher is automatically extended by six months. There is no entitlement to a refund. Returns of vouchers due to non-use are excluded unless the reason lies with the issuer. If a passenger fails to cancel an agreed appointment at least 24 hours in advance, the voucher becomes invalid. The voucher purchaser is obliged to inform the recipient of these terms and conditions.
The passenger must arrive on time for the agreed flight appointment. If the passenger fails to appear without excuse, arrives significantly late, or cancels less than 24 hours before the appointment, Paragliding Oberbayern powered by Thermik-Flug may refuse to carry out the flight at a later date but remains entitled to demand full payment. Savings or alternative earnings must be taken into account. Significant delay is deemed to exist particularly if the delay disrupts subsequent scheduled flights.
The passenger expressly declares that they are physically and mentally fit, have no heart or circulatory conditions, balance disorders, neurological conditions, or other (including chronic) illnesses, and are capable of handling the stresses of the flight. If in doubt, the passenger must obtain medical clearance.
The passenger is obliged to cancel the flight if no theoretical briefing has taken place or if it has not been fully understood. The passenger must also cancel if under the influence of alcohol, drugs, or medication.
The passenger must wear suitable clothing (weather- and windproof, suitable for dirt) and sturdy shoes (covering the ankles). Paragliding Oberbayern powered by Thermik-Flug will provide helmet and flight equipment.
For minors, consent from a parent or legal guardian is required.
The passenger must strictly and immediately follow all instructions given by the pilot. This is for their own safety.
Please note that paragliding may involve risks, particularly during take-off and landing, where accidents may occur due to stumbling or incorrect behavior. We strive to minimize these risks. Failure to follow instructions may endanger both passenger and pilot.
Failure to follow the pilot’s instructions may result in exclusion from the flight without any entitlement to a refund.
The passenger is liable for damages caused by failure to follow instructions. The passenger is also liable for intentional or grossly negligent damage to equipment, pilots, or third parties.
Liability of Paragliding Oberbayern powered by Thermik-Flug, its owners, partners, and pilots for damages caused by simple negligence is excluded. This applies regardless of the legal basis, cause, or extent of damage, including personal injury, property damage, financial and non-financial loss, and consequential damages. This exclusion does not apply if an insurance covers the damage without recourse. Liability is limited to statutory minimum coverage amounts. Insurance coverage exists in accordance with applicable aviation laws.
Appropriate insurance is in place in accordance with German aviation law. Personal belongings (e.g. glasses, cameras, mobile phones, valuables) must be properly secured. Otherwise, Paragliding Oberbayern powered by Thermik-Flug accepts no liability for loss or damage.
Should any provision of these terms be invalid, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid one that most closely reflects its intent. Place of jurisdiction and performance is Munich.
